TERMS OF SERVICE (TOS)
ANY PERSON OR INDIVIDUAL USING OUR SERVICES AGREES TO THESE TERMS
AUTOMATICALLY AND IS LEGALLY BOUND BY THESE TERMS!

BestAuctionHost.Com
BestAuctionHost.Com furnishes Internet World Wide Web page hosting,
dedicated servers, web design, ISP, and email services.
BestAuctionHost.Com has particular legal and moral responsibilities
regarding the use of its computer network and apparatus involved in
these services.
BestAuctionHost.Com common policy is to act as a neutral provider of
access to the global Internet. BestAuctionHost.Com has specific
moral concerns in respect to the use of its computers detailed
below. BestAuctionHost.Com reserves the right to suspend or revoke a
customer's access to any or all services provided by
BestAuctionHost.Com when BestAuctionHost.Com determines that the
account has been used unacceptably.
Our Legal Right To Refuse Service
We reserve the right to refuse service and/or cancel services
(refunding unused months paid for) to/for any customer that is
abusive or disrespectful of our policies or to our employees/owner's
using any communication method!
This is our legal right and is not
negotiable and may be implemented at our discretion at anytime we
feel it necessary!
Specific Acceptable Use Policies
BestAuctionHost.Com will firmly react to any use or attempted use of
an Internet account or computer without the owner's permission.
Password cracking, security hole scanning and other related uses
will not be tolerated. Any unauthorized use of accounts or computers
by a BestAuctionHost.Com customer, whether or not the attacked
account or computer belongs to BestAuctionHost.Com, will result in
action against the assailant. Possible responses include warnings,
account suspension or nullification, and civil or criminal legal
action, according to the severity of the attack.
Auction Rules: — (CODE OF CONDUCT)
1.You may NOT insert fake users into an auction for any reason
except testing.
(One test account is acceptable for testing purposes only)
2. You may NOT bid on any items you are selling yourself or allow
any user to do this either with your knowledge it is being done!
(CHECK the users/bidder IP address on an auction)
3. You may not post/allow posts from others that are ILLEGAL in any
manner for sale on your auction! Sales of HUMANS, HUMAN ORGANS, or
HUMAN BODY PARTS are NOT ALLOWED in any manner or form!!
4. NO PORNOGRAPHIC MATERIALS OR SERVICES may be posted on your
auction at any time!
5. You have a moral obligation to verify as best you can, the authenticity of all new
users before allowing them to
bid/sell on your auction service!!
6. We reserve the right to check your database, if we receive a
complaint, to check that you are INDEED running a LEGITIMATE auction
service on our servers!
7. FAKE posts of non existent items (or of a questionable nature
outside the scope of normal auction items) done to DRAW WEB
TRAFFIC.....like auctioning off your girlfriend......IS NOT ALLOWED!
8. We do not host auction sites that ONLY sell FAKE or KNOCK-OFF items
that are registered brand names!
9. The MAXIMUM time frame for any auction SHOULD be set at no longer
than 30 days unless there is a valid reason to do so, like a home or
business for instance!
10. You MAY NOT allow users under 18 years of age to REGISTER, BUY,
or SELL on your auction site!
WARNING:
IF we find any evidence you are not running a legitimate auction,
your account will be IMMEDIATELY TERMINATED and NO REFUNDS we will
given for unused time!
If we are contacted by the authorities as to illegal activities, you
are hereby warned that we will co-operate with them fully in your
prosecution to protect ourselves!
DNS Policies
BestAuctionHost.Com does not delegate authority of its address space
to anyone for any purpose. BestAuctionHost.Com will provide all
reverse DNS entries for address space as long as the DNS entry does
not contain profanity or terminology that BestAuctionHost.Com deems
offensive in nature. BestAuctionHost.Com will not provide reverse
DNS for "vanity" domains.
Email Usage and Broadcasts
UCE and UCB mailings are specifically prohibited on this system by
anyone! Relaying and using mailing lists are NOT ALLOWED! This is a
ZERO-TOLERANCE mailing system! You may forward email to multiple
recipients as long as they have agreed to receive your message in
this manner. HOWEVER, if we receive one ABUSE complaint about your
account because of using this method, you will be deemed to be
spamming the Internet and your account will be terminated after ONE
WARNING!
Commercial advertisements are unwelcome in most User groups and on
most email mailing lists. Inappropriate posting may result in
account suspension or cancellation. See the newsgroup or mailing
list's charter for whether advertising is accepted or not.
"Spamming," or sending a message to numerous different off-topic
newsgroups, is especially unethical and will be treated as such.
Dedicated server clients and co-location clients can send email with
the use of bulk email software only with the consent of
BestAuctionHost.Com management. Sending a message, notably an
advertisement, to several recipients, is also considered spamming
unless the individuals have precisely requested to be added to a
mailing list on that topic. Email was not intended to be a broadcast
medium. BestAuctionHost.Com will not tolerate any abuse of it's
email system. File transfers, mailing list broadcasts and any other
action deemed by BestAuctionHost.Com to be inappropriate will result
in IMMEDIATE account termination.
Account and FTP abuse
BestAuctionHost.Com clientele are privileged to be offered limitless
traffic, where applicable, for their web sites. It is
BestAuctionHost.Com's intent to serve web documents. All web pages
(html) must be "linked" with files stored on
BestAuctionHost.Com's
server. Web sites that are found to contain either no html
documents, or a great number of unlinked files are subject to
warning, suspension or revocation at the discretion of
BestAuctionHost.Com administration. All FTP sessions are logged, if
you do not agree with this policy then please contact
BestAuctionHost.Com before purchasing an account. Uploading and/or
downloading of illegal, copyrighted or licensed software for the
purposes of distribution and/or personal use will not be tolerated
and will result in immediate account suspension and/or termination.
Payment Policies
The first month, quarterly, semi-annual, or yearly payments must be prepaid for
any of BestAuctionHost.Com's services and is refundable at our
discretion depending on the circumstances of the cancellation.
Payment is due every month on the day you started service with us. Any account not paid by the
due date is subject to suspension at our discretion. The
customer is responsible for all currency owed on the account from
the time it was instituted to the time that the customer notifies
BestAuctionHost.Com to terminate
service. Returned checks will be assessed a $25 bad check charge.
All payment is in U.S. currency.
Past Due Payment Collection Alternative
If an auction site becomes past due or appears to be abandoned by
it's owner, we have the right to assume ownership of the site and
domain name in lieu of payments not made. We may change the auction
to a FEE BASED auction at our discretion to recover our fees due and
not paid. Extra funds, if any, will be divided between us and the
original owner of the auction! There will be a management and
collection fee charged against any excess profits a site may
generate, before any excess funds are distributed. If the owner
cannot be located, we have the right to sell or bid out the domain
to the highest bidder, totally at our discretion. If the owner
decides later on to re-claim the domain, we can allow this, or deny
it, at our discretion.
Credit Card Information
It is the customers responsibility to keep all credit card
information current at all times. We must be notified if you change
names, address, account numbers, marital status, telephone #'s, card
expiration date, or CVV2 security numbers on the back of your card
on the signature line IMMEDIATELY. This prevents accounts from
interruption of services and us not being able to charge them
correctly. It also prevents accounting errors that occur in these
situations! It IS NOT our job to contact you! You are SOLELY
responsible for keeping your billing information current with us!
Credit and Debit Cards – Use and Authorizations
Payment for the services provided to you at and/or through
BestAuctionHost may be made by automatic credit card or debit card.
You hereby authorize BestAuctionHost and/or its authorized agent to
transact such payments on your behalf. Unless you have a good faith
reason to believe the card you use to purchase your subscription is
lost or stolen, you agree not to report that card as lost or stolen.
You also agree not to dispute any authorized charge by
BestAuctionHost or its authorized agents. You agree and acknowledge
that if you fraudulently report the card used to obtain your
subscription as stolen, or if you fraudulently report that an
authorized charge by BestAuctionHost or its authorized agents is
unauthorized, you shall be liable to BestAuctionHost for liquidated
damages of Five Hundred Dollars ($500.00) per incident. The
liability for liquidated damages specified in this section shall not
limit any other liability you may have for breach of any other
terms, conditions, promises, representations or warranties.
Cancellation of Services Procedure
BestAuctionHost.Com reserves the right to cancel service at any
time. Customers that do NOT give us 30
days notice of intent to move their domain to another server FORFEIT
any/all monies paid. NO REFUNDS without 30 days notice to us of
intent to move the hosting elsewhere!
NO EXCEPTIONS!
To cancel services with us, you MUST go to our home page and click
on the "STOP Services" button and fill in the form found there to
cancel services and billing for your account!! Any customer that issues a chargeback before doing the
above agrees to be charged an extra $500 to their account to handle
the paperwork involved to dispute the issue!
Lawful Intent
BestAuctionHost.Com reserves the right to deny service to anyone.
Customers may only use BestAuctionHost.Com's web hosting account(s),
dedicated server(s), co-location service(s) and email service(s) for
lawful purpose. Transference of any information in violation of any
Federal, State or Local laws is forbidden. This includes, but is not
restricted to copyrighted data, information legally judged to be
threatening or obscene, and information protected by privacy rights.
BestAuctionHost.Com prohibits anyone from using BestAuctionHost.Com
web hosting account(s), dedicated server(s), co-location service(s)
and email service(s) for the reproduction, dispersing, storing,
processing, or handling in any way obscene or pornographic material,
or any other data which we believe to be unacceptable, including,
but not restricted to, pornography, malicious materials, and any and
all information of an adult nature. The designation of any
information as regards to above is left completely to the option of
BestAuctionHost.Com administration. BestAuctionHost.Com's web
hosting account(s) are designed for the buyer only. Customers cannot
sublease, or grant control of any share of BestAuctionHost.Com's web
hosting account(s). If one does the aforementioned, termination of
services is likely.
Indemnity
Customer agrees that it will protect, indemnify, save and hold
BestAuctionHost.Com armless from any and all stipulations, arrears,
losses, expenses and assertions, as well as rational attorney's fees
declared against BestAuctionHost.Com, its representatives, its
customers, and administration that may arise or result from any
service provided or executed or agreed to be executed or any product
sold by customer, it's agents, employees or assigns. Customer agrees
to defend, indemnify and hold harmless BestAuctionHost.Com against
liabilities arising out of any injury to person or property caused
by any products sold or distributed in association with
BestAuctionHost.Com's services, any material furnished by customer
encroaching or supposedly encroaching on the exclusive rights of a
third party, copyright violation and any defective products sold to
customer from BestAuctionHost.Com’s services.
Disclaimer
BestAuctionHost.Com is not responsible for any damages your business
may suffer. BestAuctionHost.Com does not make implied or written
warranties for any of our services. BestAuctionHost.Com denies any
warranty or merchantability for a specific purpose. This includes
loss of data resulting from delays, non deliveries, wrong delivery,
and any and all service interruptions caused by BestAuctionHost.Com.
BestAuctionHost.Com reserves the right to amend it's policies at any
time.
System or Hardware Changes Required
BestAuctionHost.Com reserves the right to require any and all
customers to upgrade hardware or software to make our services work
with our customers computers correctly due to changes in the way the
Internet functions in the future. From time to time upgrades may be
required on our servers or dialup systems also! Users must comply
with our instructions to upgrade, download, or install additional or
different hardware or software to assure compatibility with our
computers and dial up system(s)! Users failing to comply within the
timeframe we specify to make changes or upgrades will have their
account deleted and NO REFUNDS will be made/issued for this type of
violation!
Privacy Policy
At no time will we give out or divulge ANY information about you,
your website, your domain, or any personal information to anyone
under any circumstances! Only LAW ENFORCEMENT entities with proper
summons to release the information requested will be honored by us
in releasing any customer information!
Customer Contact Information
It is the customers responsibility to check their WEBMASTER email
account on our
system regularly for updates and or system wide changes we make!
Refunds Policy
There are NO REFUNDS for services already rendered to a customer! We
DO NOT provide refunds,
except under circumstances when we cannot provide a service we
advertise, that you have previously ordered from us, and that
service was not provided or completed normally by us! IF we did our
job and others ISP problems arise not controllable by us, NO REFUND
can be made!
NO EXCEPTIONS!
Support Abuse
Any customer that abuses our support system by constantly filing
'tickets' for the same problem, flaming support personnel, using
abusive language, or any other activity we deem unacceptable, may
have their account cancelled by us, at our discretion! Customers
'locking' themselves out of their account by using illegal
activities or causing them to be locked out constantly by our BFD
and Firewall systems will be charged a 'per incident fee' of $25.00
to restore their access, if the practice becomes excessive, (more
than 6 incidents per year).
Domain Hacking - Immediate Suspension Can Occur
We reserve the right to IMMEDIATELY SUSPEND any domain on our
servers that places the other domains at risk, due to repeated
hacking or spamming techniques injected into any domain by anyone.
Whether or not we allow the domain back online, after it has been
cleaned up, is at our discretion!
